At Downpour Interactive, LLC, (referred to as "Provider," "us" or "we"), we recognize that your privacy is important. This Privacy Policy discloses the privacy practices for the Onward platform (the "Site") as well as related PC/console games, websites, mobile applications, products, and services we may offer to you, (collectively referred to as the "Services"). This Policy also covers how personal and other information about you that we receive or collect through the Site and Services is treated. Please read the information below to learn the following regarding your use of this Site and Services. This Privacy Policy does not govern our collection of information through any other website, mobile application or other means, other than through the Site or Services.

You acknowledge that this Privacy Policy is designed to be read in connection with the Software License Agreement, End User License Agreement, the Custom Content License and the Community Guidelines, and that by accessing or using our Site, you agree to be bound by the terms and conditions of the foregoing, and that this Privacy Policy applies to such access and use.

We reserve the right to change this Privacy Policy from time to time. If we make changes to this Privacy Policy, we will provide notice of such changes as appropriate, such as by placing a prominent notice through our Services, and taking other measures as required by law. If we make an administrative change, we will update the "Last Updated" date at the bottom of this Privacy Policy. Your continued use of the Site and/or Services after such modifications will constitute your (a) acknowledgment of the modified Privacy Policy and (b) your agreement to abide and be bound by that Policy.

This Policy is subject and supplemental to those terms and conditions of any agreement or policy between you and the platform provider you used to purchase your rights to the Services.

1. Types of Information We Collect

You may provide information to us when you choose to use the Services. In providing the Services, we may collect the following types of information about you, including through our third-party partners:

  • Identifiers, such as your email address and Oculus, Steam, and/or PlayFab usernames, VR hardware, and device identifiers
  • Country or other global geographic descriptors;
  • Details you provide in response to surveys about our products, promotions and beta testing;
  • Electronic network activity, such as gameplay activity and statistics, e.g., kills, deaths, time spent in game, login activity, and device event information, including crash reports, request and referral URL's and system activity details (e.g. whether you encountered an error playing our games or lost internet access);
  • Commercial information, including VR hardware and platform types;
  • Content which you submit e.g. custom maps; and
  • Information you provide when seeking help from us such as your name, telephone number and records of the issues you experience, or that you provide in response to surveys about our products.

When you participate in online games, in-game profile information, gameplay, and statistics may also be visible to other users. Your gameplay, in-game profile information, and in-game voice chats may also be recorded by us (and/or by other users) in connection with enforcing the terms and conditions of the Services referred to above.

We do not knowingly collect or store any personal information from children under 13. If parents or others believe that we have unintentionally collected information from children under 13, they may reach out to us via the contact address located below.

We recognize a special need to protect the personal information of children even over 13. We urge parents to instruct their children to never give out their real names, addresses, phone numbers, or other personal information without parental permission, when online. We also recommend parents familiarize themselves with parental controls available on consoles, mobile telephones, tablets, and other devices they provide to their child and accompany their child when online.

 

2. How We Use Information

We will primarily use information about you to provide the Services to you. We will also use game play activity and statistics, hardware and device identifiers, platform type, device event information and survey responses to enhance the operation of our Services, analyze statistics relating to use of the Services, and improve our product and service offerings. We may use your usernames, name, and contact information to provide you with updates related to the Services, in connection with our marketing and promotional efforts, and to contact you regarding administrative notices. Finally, we may use your username, name, contact information, game play activity and statistics, hardware and device identifiers, platform type, and device event information in connection with any beta testing you participate in and to resolve disputes, troubleshoot problems and enforce our agreements with you, including but not limited to our Software License Agreement, End User License Agreement, Custom Content Agreement, and this Privacy Policy.

 

3. Sharing of Information

We may share information about you and have in the past twelve months shared information identified above with our affiliate companies and service providers engaged by us (such as our development platform and analytics providers, PlayFab and Unity Analytics), as well as our employees, contractors, officers, directors, representatives, and agents in order to provide you with goods or services you have requested, to ensure the success and functionality of our Services, or to facilitate online advertising selected by us. In particular, information collected when using our Services may be made available for use by our service provider, PlayFab, in connection with the Services and for providing, improving and adding new features to the PlayFab services. By using our Services, you consent to this transfer and use of data and information to PlayFab, whose privacy policy can be found at https://privacy.microsoft.com/en-us/privacystatement. Further, Unity Analytics may collect, store, use, process and transfer certain information regarding your game play and other use of the Services (i) to provide its analytics services, (ii) for uses set forth in the Unity Privacy Policy, and (iii) as may be required by law or legal process.

We may also share information about you: (i) if required to do so by applicable law, regulation, or legal process; (ii) if necessary to exercise, establish or defend our legal rights; (iii) if necessary to protect the rights, property, or safety of any person; and (iv) in connection with the sale of our business or assets.

We do not sell information about you.

Occasionally we may be required by law enforcement or judicial authorities to provide personal information to the appropriate governmental authorities. Upon receipt of a search warrant, court order, subpoena, or other legal request, we may access, preserve and share information with regulators, law enforcement, or others if we have a good faith belief that the law requires us to do so. This includes responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.

 

4. Miscellaneous

You should also be aware that when personal information is voluntarily disclosed in the Services (e.g., through chat functions) or on our social media pages, that information can be collected and used by third parties and may result in unsolicited messages (including unwanted spam messages) from third parties. Such activities are beyond our control and this Policy does not apply to such information.

This Site may contain links to other external websites. Such third-party websites accessible through this Site have their own privacy policies and data collection, use, and disclosure practices. 5. Data Privacy Requests

We believe that you should have the ability to access and edit the personal information we have collected about you, and we encourage you to promptly update your personal information if it changes. You may also ask to have your personal information deleted or removed. These and other rights which may apply are set out in more detail below, and in certain circumstances and subject to certain exceptions, you may have the right to:

  • request that we disclose to you the personal information we collect, use, or disclose, and information about our data practices;
  • request that we delete the personal information that we have collected about you;
  • not be discriminated against for exercising the right to know or right to request deletion;
  • request that we rectify any personal information about you which is inaccurate;
  • request that we stop processing personal information about you; and
  • object to us processing personal information about you, or to withdraw your consent.

Only you, or someone legally authorized to act on your behalf, may make a request related to personal information collected about you. To designate an authorized agent, the authorized agent must provide sufficient information that allows us to reasonably verify that they have been authorized by you to act on their behalf.

6. Additional Information for Users from California

Since 2005, California Civil Code Section 1798.83 permits our users who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share our customer's personal information with unaffiliated third parties for their own direct marketing purposes.

Since January 1, 2015, California Business and Professions Code Section 22581 permits you, if you are a California resident under the age of 18, to view, correct, or remove information provided by you or publicly posted by you. . You may send us an email asking us to remove such content using the address in the Contact Us section below. In the alternative, you may write to us using the address in the Contact Us section below.

We will be happy to review, update, remove or anonymize information and/or content as appropriate. Residual copies of information and/or content that have been removed from your account and/or the Site may remain in our backup systems for approximately one month. We may still retain your information to resolve disputes, enforce our user agreement, or comply with legal requirements; in this case, your personal information will be blocked from use for any other purpose.

California Business and Professions Code Section 22575(b) (as amended effective January 1, 2014) permits our customers who are California residents to be informed as to how we respond to web browser "Do Not Track" settings. As Do Not Track is a standard that is currently being developed, we do not take actions to respond to Do Not Track settings, and instead we adhere to the standards set out in this Privacy Policy. 7. Disclosures to Users Outside the United States

If you use our Services from outside the U.S., in order to provide our Services the personal information you provide will be collected, processed and stored directly on, or transferred to, servers in the United States or other countries that may not have equivalent data protection laws to the country where you reside.
